These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and KinkCity ("Company", "we", "us", "our") governing your access to and use of the KinkCity platform, including any content, functionality, and services offered on or through kink.city (the "Platform").

By accessing or using the Platform, you confirm that you are at least 18 years of age, that you have read, understood, and agree to be bound by these Terms, and that you agree to our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

KinkCity is an 18+ community platform specifically designed for adults within the kink, BDSM, and fetish community. It enables registered contributors to list events, venues, services, and news articles for specific cities. The Platform is designed to help adults within the kink community discover events, spaces, and services in cities where KinkCity operates.

The Platform operates on a contributor model: users may browse all public content without registration, but creating listings or publishing content requires an approved contributor account. Contributor accounts are subject to role-based access controls as described in Section 5.

We reserve the right to modify, suspend, or discontinue the Platform (or any part of it) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

To access contributor features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security of your account credentials and not share them with third parties.
• Notify us immediately of any unauthorised use of your account or any other security breach.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, provided false information, or engaged in conduct that is harmful to other users, third parties, or the Platform.

Account registration is subject to approval by a Site Admin or City Admin. We reserve the right to reject any application without providing a reason.

The Platform operates a role-based access system. The following roles are available to registered contributors:

Roles are assigned to specific cities. A contributor approved as an Event Promoter in London may not create listings in Berlin without a separate application and approval for that city.

The Platform allows approved contributors to submit, post, and publish content including event listings, venue profiles, service listings, news articles, and images ("User Content"). By submitting User Content, you:

• Represent and warrant that you own or have the necessary rights, licences, and permissions to submit the content and to grant the rights described below.
• Grant KinkCity a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Platform.
• Represent and warrant that your User Content does not infringe any third-party intellectual property rights, privacy rights, or other rights.
• Represent and warrant that your User Content is accurate, not misleading, and complies with all applicable laws and regulations.

You retain ownership of your User Content. The licence granted above terminates when you delete your content or your account, except where content has been shared with others and they have not deleted it.

KinkCity is strictly an 18+ platform. By accessing the Platform, you confirm that you are at least 18 years of age. If you are under 18, you must not use the Platform. We reserve the right to terminate any account where we have reason to believe the user is under 18.

The Platform is intended for consenting adults within the kink, BDSM, and fetish community. Content on the Platform may include descriptions of adult events, venues, and services of a sexual or fetish nature. All such content must relate to activities between consenting adults and must comply with applicable law.

The following types of content are strictly prohibited on the Platform:

• Any content that involves or depicts minors in any sexual or adult context.
• Explicit photographic or video imagery of a sexual nature.
• Content that promotes or facilitates non-consensual activities.
• Content that promotes or facilitates illegal activities, including prostitution or trafficking.
• Content that promotes hate, discrimination, or violence based on protected characteristics.

Violation of these restrictions will result in immediate account termination and may be reported to the relevant authorities. If you encounter content that violates these restrictions, please contact us immediately at [email protected].

You agree not to use the Platform to:

• Submit false, misleading, or fraudulent listings or information.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or any other malicious code.
• Attempt to gain unauthorised access to any part of the Platform or its related systems.
• Scrape, crawl, or use automated means to access the Platform without our prior written consent.
• Post content that is defamatory, obscene, hateful, threatening, or otherwise objectionable.
• Violate any applicable local, national, or international law or regulation.
• Use the Platform to send unsolicited communications (spam).
• Interfere with or disrupt the integrity or performance of the Platform.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Platform.

Violation of these prohibitions may result in immediate termination of your account and, where appropriate, referral to law enforcement authorities.

The Platform and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of KinkCity and its licensors. The KinkCity name, logo, and all related marks are trademarks of KinkCity. You may not use our trademarks without our prior written consent.

Nothing in these Terms grants you any right to use KinkCity's intellectual property for any purpose other than your personal, non-commercial use of the Platform. All rights not expressly granted are reserved.

The Platform may contain links to third-party websites, ticket platforms, and services. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply our endorsement of the linked site. When you leave the Platform, our Terms and Privacy Policy no longer apply.

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that: (a) the Platform will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Platform is free of viruses or other harmful components; or (d) the results of using the Platform will meet your requirements.

To the fullest extent permitted by applicable law, KinkCity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Platform.

Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of £100 or the amount you paid to us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless KinkCity and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Platform, including but not limited to your User Content, your use of any information obtained from the Platform, or any infringement of any intellectual property or other right of any person or entity.

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

You may terminate your account at any time by contacting us. Termination does not affect any rights or obligations that arose before the termination date. Sections 5, 7, 9, 10, and 12 of these Terms survive termination.

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute arising out of or relating to these Terms or the Platform.

Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within 30 days.

These Terms constitute the entire agreement between you and KinkCity regarding the Platform and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations under these Terms without our prior written consent.
